This website is operated by Pawfolio Art, a custom pet gift store operated by Northvale Brands LLC. Throughout the site, the terms "we," "us," and "our" refer to Pawfolio Art. We offer this website, including the information, tools, products, and services available from this site, to you conditioned upon your acceptance of these Terms of Service and any policies referenced here.

By visiting our site, browsing our products, uploading a pet photo, placing an order, or otherwise using our store, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our website or purchase from us.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

SECTION 2 - ONLINE STORE TERMS

By using this site, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have consent from a parent or legal guardian to use this site.

You may not use our products, website, or services for any unlawful or unauthorized purpose. You may not transmit viruses, malicious code, or anything intended to harm, disrupt, or interfere with the operation of the website.

SECTION 3 - OUR PRODUCTS AND CUSTOM ARTWORK

Pawfolio Art creates custom pet products, including portraits, canvas prints, mugs, blankets, pillows, clothing, stuffed animals, and other personalized gifts. Because our products are made using the photo, name, style choices, size choices, and other details you provide, each custom item is made specifically for that order.

We do our best to show product colors, sizes, frames, materials, and artwork styles clearly and accurately. However, colors and details may vary slightly due to screen settings, production methods, fabric texture, print surfaces, hand-finishing, or other normal manufacturing differences.

Product availability, descriptions, prices, promotions, and shipping estimates may change at any time without notice. We reserve the right to discontinue any product or service at any time.

SECTION 4 - PERSONAL USE AND COMMERCIAL RESTRICTIONS

Unless we agree otherwise in writing, products purchased from Pawfolio Art are intended for personal, household, or gift use. You may not copy, reproduce, resell, commercially exploit, or use our custom artwork, product designs, artwork examples, website content, or finished designs to create or sell competing products without our written permission.

You may not use our products, designs, or services in a way that infringes another person's intellectual property, privacy, publicity, or other rights.

SECTION 5 - PET PHOTOS, NAMES, AND CUSTOMER CONTENT

When you upload a pet photo, pet name, or other order details, you confirm that you own or have permission to use that content. You grant Pawfolio Art and our artists, production partners, print providers, and fulfillment partners a limited right to use the content you provide for the purpose of creating, reviewing, producing, fulfilling, shipping, and supporting your custom order.

You agree not to upload content that is unlawful, harmful, offensive, misleading, invasive of another person's privacy, or infringing on another person's copyright, trademark, publicity, or other rights.

If the photo you upload is unclear, too small, heavily cropped, or otherwise unsuitable for production, we may contact you for a replacement photo or additional information. This may affect production time.

If you submit a review, testimonial, product photo, finished artwork photo, social media post, tag, or other content for public display, or otherwise give us permission to share it, you grant Pawfolio Art a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share that content for our website, social media, advertising, email, printed materials, and other marketing or business purposes. We will handle personal information according to our Privacy Policy.

SECTION 6 - ARTWORK PROOFS AND APPROVAL

For products that include an artwork proof, we aim to email your proof within the timeframe described on the product page. Proof timing is an estimate and may vary based on order volume, photo quality, product type, and production queue.

You are responsible for reviewing your proof carefully, including artwork, spelling, pet name, layout, background, size, and product choices. Once you approve a proof, or if production begins according to the process described on the product page or in our emails, changes may no longer be possible.

SECTION 7 - ORDERS, BILLING, AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate billing, shipping, contact, and order information. We may use the email address, shipping address, and phone number provided at checkout to contact you about your order, proof, shipping, or customer support request.

We reserve the right to refuse, limit, or cancel any order at our discretion, including orders that appear fraudulent, abusive, incomplete, incorrectly priced, or placed by resellers or unauthorized distributors. If we cancel or change an order, we may attempt to notify you using the contact information provided at checkout.

SECTION 8 - CANCELLATIONS, RETURNS, AND REFUNDS

Because custom products are made specifically for you, cancellations, returns, refunds, and replacements are handled according to our Refund Policy and the product-specific information shown on our website.

If you need to cancel an order, please email us as soon as possible at support@pawfolioart.com. Once artwork or production has started, cancellation may not be possible.

If your order arrives damaged or there is a production issue, please contact us with your order number and clear photos so we can review the issue and help with the next steps.

SECTION 9 - SHIPPING AND DELIVERY

Shipping timelines are estimates and may vary based on product type, production time, destination, carrier delays, customs processing, holidays, weather, or other circumstances outside our control.

You are responsible for providing a complete and accurate shipping address. If an address is incorrect, incomplete, or needs to be changed after an order is placed, please contact us immediately. We cannot guarantee that address changes can be made once production or shipping has begun.

International customers are responsible for any duties, taxes, customs fees, or import charges that may apply unless otherwise stated at checkout.

If we learn that an order cannot be shipped within the timeframe stated on our website, product page, checkout, or order communications, we may contact you with updated timing and available options. Where required by applicable law, you may have the right to cancel an unshipped order and receive a refund.

We may remove or refuse content that we believe is unlawful, harmful, misleading, offensive, or in violation of these Terms.

SECTION 14 - SMS/MMS MOBILE MESSAGE TERMS

If you choose to opt in to SMS or MMS messages from Pawfolio Art, you agree to receive recurring text messages about your order, account, cart, promotions, offers, or other store updates at the mobile number you provide. Consent to marketing text messages is not required to make a purchase. Message and data rates may apply, and message frequency may vary.

You can opt out of marketing text messages by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT where supported, or by using any other reasonable opt-out method we make available. Mobile carriers are not liable for delayed or undelivered messages. SMS and MMS services may not be available in all areas or through all carriers. We may update, suspend, or discontinue our mobile messaging program at any time, subject to applicable law.
